Terms of Service

1. Account & Eligibility

You must be at least 13 years old or meet the minimum age of majority in your jurisdiction to use the Service. You are responsible for maintaining the confidentiality of your account and credentials, and for all activities that occur under your account. Please contact us immediately if you discover any unauthorized use.

2. License & Intellectual Property

The Service and its content are owned by us or our licensors and are protected by intellectual property rights. Subject to these Terms, we grant you a personal, limited, non-transferable, non-sublicensable, revocable license to use the Service.

You may not copy, modify, distribute, rent, sell, reverse engineer, or create derivative works of the Service without our prior written permission.

3. User Content

You retain all rights to content you submit, upload, or publish ("User Content"). You grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, display, reproduce, modify, create derivative works from, and distribute your User Content for the purpose of operating, promoting, and improving the Service.

You represent and warrant that you have the necessary rights to your User Content, that your User Content does not infringe the rights of any third party, and that your User Content complies with applicable laws. We may remove or restrict User Content at our discretion if we believe it violates these Terms or applicable law.

4. Prohibited Conduct

• Use the Service in any unlawful manner or in a manner that infringes the rights of others;
• Upload, transmit, or distribute unlawful, infringing, fraudulent, malicious code, or other harmful content;
• Interfere with, disrupt, probe, or circumvent the security or technical limitations of the Service, including through web crawling/bulk scraping or excessive high-frequency requests that cause overload;
• Use the Service for unauthorized commercial resale, bulk annotation, model training, or purposes that conflict with these Terms.

5. Subscriptions, Purchases & Auto-Renewal

• Paid features may be billed through app stores or third-party billing services (such as RevenueCat); prices may change and may include taxes.
• Auto-Renewal: Unless you cancel before the end of the current billing period, your subscription will automatically renew and be charged at the then-current rate.
• Cancellation & Refunds: If you subscribe through the Apple App Store or Stripe (web), cancellation and refund policies are governed by their respective policies; we will comply with applicable mandatory consumer protection laws. Android is provided as a direct APK download and is not distributed via app stores.
• We will provide reasonable advance notice of material price changes; continued use after changes take effect constitutes acceptance of the new pricing.

6. Third-Party Services & Links

The Service may integrate with or link to third-party services (such as hosting, analytics, messaging infrastructure, and payment/subscription management). Third-party services are provided by their respective providers and are governed by their own terms and privacy policies.

7. Privacy

Your use of the Service is governed by our Privacy Policy, which explains how we collect, use, share, and protect your information and your rights.

8. Service Availability & Changes

We may add, modify, or discontinue features of the Service in whole or in part, and may suspend the Service under reasonable circumstances (such as maintenance, upgrades, security incidents, or legal requirements). If material permanent changes occur, we will provide reasonable notice.

9. Termination

We may suspend or terminate your access to all or part of the Service without prior notice if you violate these Terms, engage in illegal/infringing/abusive conduct, or for legal or security reasons. You may stop using the Service at any time. Certain provisions (such as intellectual property, disclaimer, limitation of liability, and dispute resolution) survive termination.

10. Disclaimer

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted/error-free operation.

Some content in the Service (including listening content and word explanations) may be generated by artificial intelligence. It may be inaccurate or incomplete and is provided for informational and educational purposes only; it is not professional advice. You are responsible for how you use the content.

11. Limitation of Liability

To the fullest extent permitted by law, we and our affiliates shall not be liable for any indirect, incidental, special, punitive, or consequential damages, or for loss of profits, revenue, data, or goodwill.

In no event shall our total cumulative liability for all claims related to the Service exceed the amount you paid for the Service in the previous calendar year; if you are a free user, this limit is $100 USD or the minimum limit permitted by applicable law (whichever is greater). The foregoing limitations do not exclude liability that cannot be excluded under applicable law.

12. Copyright & Complaints

If you believe that content in the Service infringes your rights, please email [email protected] with: (i) identification of the copyrighted work or right you claim is infringed, (ii) the exact URL(s) of the allegedly infringing content, (iii) your contact information, (iv) a statement of good-faith belief that the use is not authorized, and (v) a statement that the information is accurate and you are authorized to act, with your signature (physical or electronic). We may remove or disable access to the content while we review.

If you encounter content that is illegal, harmful, or otherwise inappropriate, or you believe the Service is being abused, please report it to [email protected] with the relevant URL(s) and context. We may take action, including removal or restriction, consistent with applicable law.

13. Minors

We do not target children under 13 years of age and do not knowingly collect their personal data. If you believe a child has provided us with information, please contact [email protected] so we can delete it.

14. Export & Compliance

You agree not to use the Service for purposes that violate applicable export controls, sanctions, or other compliance requirements, nor to provide the Service or content to restricted parties.

15. Changes

We may update these Terms from time to time and display the "Last Updated" date on the page; continued use after updates take effect constitutes acceptance of the modified Terms.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in these Terms affects your statutory consumer rights in your country of residence.

17. Miscellaneous

• Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between the parties regarding the Service.
• Severability: If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in effect.
• Assignment: You may not assign your rights or obligations under these Terms without our written consent; we may assign them in connection with a merger, acquisition, or asset transfer.
• Notice: We may provide notice to you via in-app messages, email, or website announcements.
